SubscRINGtion™ Terms & Conditions

AUTO-RENEWAL PROGRAMS – SubscRINGtion™ – Updated May 2023

 

If you are enrolling in our SubscRINGtion auto-renewal program in which you have requested that we provide eligible ring products (“Products”) to you upon your selection on the Site, at a cadence of your choosing (the “Program”), your membership in the Program will remain in effect until cancelled. When you place your first order and enroll in the Program, you will thereafter, have the opportunity to select a Product. Thereafter, the timing of a Product exchange is subject to your choosing.  As long as you continue to participate in the Program, you shall be charged every 30 days.   

 

You will have the option at any time during your enrollment in the Program to convert your SubscRINGtion auto-renewal Program into a purchase of the current Product in your possession (the “Buy-Out Option”). Each Product has a purchase price of $480.00 (the “Buy-Out Price”). Upon notice to Manly Bands via email, chat support, or telephone of your decision to purchase the current Product in your possession, Manly Bands will send a payment invoice to your email and you will be responsible for paying the invoice which shall set forth the difference between the Buy-Out Price and any past charges already invoiced as part of the Program. If your past charges for the Program exceed the Buy-Out Price, upon your election of the Buy-Out Option, you will owe no further fees hereunder. For the avoidance of doubt, in no case is Manly Bands liable to reimburse you for any fees or payments paid hereunder, even if the charges already invoiced in accordance with the Program, exceed the Buy-Out Price.  Upon your election of the Buy-Out Option, Manly Bands will automatically unenroll you from the Program prior to the next charge.

 

If you sign up for the Program on the Site in connection with your purchases, the manner of payment you provide, including but not limited to a payment card, will be automatically charged for the price of the Program (which is inclusive of shipping and handling charges), plus applicable taxes.  You must provide current, complete, and accurate information for your shipping and billing accounts upon sign-up. You are responsible for ensuring this information is correct and must promptly update all information to keep your account current, complete, and accurate (for example, to reflect changes in shipping or billing address, credit card number, credit card expiration date, and security code). Such updates shall be made via email, chat support, or telephone. Shipments sent to the address of record are deemed complete upon shipment; we are not responsible for your failure to receive a shipment sent to your address of record in the event you have moved or for any other reason. You must promptly notify Manly Bands if your credit card or alternative payment method is cancelled or no longer valid (for example, due to theft or loss). You may make such changes to your account by calling Manly Bands via telephone, via Chat Support on the Site, or by \ email at hello@manlybands.com For clarity, you may always cancel your enrollment in the Program via the customer portal.

 

If you sign up for the Program, you will be charged regularly and automatically for, and delivered (at your discretion), the selected Products until you cancel your participation in the Program and/or you choose to purchase a particular Product by selecting the Buy-Out Option. By participating in the Program, you agree that we may charge you for the Program(s), applicable taxes, and any applicable shipping and handling charges, WITHOUT OBTAINING ANOTHER PAYMENT AUTHORIZATION FROM YOU. These subsequent charges will be placed on the payment card or alternative payment method you provided when you enrolled in the Program or update thereafter. You agree that we will not be responsible in any manner for any overdraft charges, interest charges late or other fees, or damages (including consequential damages) you may incur as a result of charges placed on your payment card or alternative payment method.

 

THE AUTO-RENEWAL PROGRAM WILL REMAIN IN EFFECT UNTIL YOU CANCEL IT. IF YOU WISH TO CANCEL YOUR PARTICIPATION IN THE PROGRAM AND DISCONTINUE SHIPMENT OF FUTURE SERVICES OR PRODUCTS, YOU MAY DO SO BY LOGGING INTO YOUR ACCOUNT IN THE CUSTOMER PORTAL AND SELECTING “CANCEL SUBSCRIPTION” OR BY EMAILING MANLY BANDS AT hello@manlybands.com OR BY CALLING MANLY BANDS VIA TELEPHONE OR VIA CHAT SUPPORT ON THE SITE. If you cancel your subscription after we have shipped your order, you may return it according to our return policy in the section above.

 

Only customers with a shipping address located in the United States of America are eligible to participate in the Program.

 

We may, in our sole discretion, terminate your participation in the Program at any time without notice to you. We will not give any refund for termination related to conduct that we determine, in our discretion, violates these Terms or any applicable law, involves fraud or misuse of the Program, or is harmful to our interests or another user. Our failure to insist upon or enforce your strict compliance with these Terms will not constitute a waiver of any of our rights. We reserve the right to refuse or discontinue the automatic provision of services or products to anyone or any account at any time in our sole discretion.

 

We may in our discretion change the terms of the Program. YOUR CONTINUED MEMBERSHIP AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR MEMBERSHIP.

 

IN ADDITION TO OTHER LIMITATIONS AND EXCLUSIONS IN THESE TERMS, OUR TOTAL LIABILITY IN CONNECTION WITH THE PROGRAM, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE FEES YOU PAID TO PARTICIPATE IN THE PROGRAM. THIS LIMITATION OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE CANCELLATION OR TERMINATION OF YOUR SubscRINGtion MEMBERSHIP.
